The payment of the contract price will be made in the currency as set out in the Purchase Order in accordance with the payment condition. The payment shall not be deemed as release of the Vendor from its responsibilities of the Contract.
根据付款条件，合同的价格将按定货单所指定的货币支付。卖方在合同中的责任将不会因货款已支付而被免除。
For security of the Vendor’s guarantee referred to in Article 8 hereof, the Vendor shall establish, at its own expenses, a Performance Bond in a form of letter of bank guarantee acceptable to the Purchaser not later than thirty (30) days after formal contract.
This Performance Bond shall be for ten percent (10%) of the contract amount and valid until the expiry date of the guarantee liability of the Vendor under Article 8 hereof.
为了确保卖方履行本合同第8条款所述的保证，在本合同正式签署后30天之内，卖方将自费提供一份买方认可的银行保函作为履约保证。
本履约保证的金额为合同价款的10%，其有效期将根据合同第8款规定的卖方责任保证期限为准。
4. TIME AND CONDITIONS OF DELIVERY

The Vendor agrees to start its performance under this Contract promptly after receipt of the Letter of Intent/or the Purchase Order whichever issued earlier and execute all phases of the same with promptness and diligence and the Vendor shall guarantee that the Goods are delivered not later than the time of shipment set out in the Purchase order on the conditions mentioned in the Purchase Order. If the Goods or the part thereof are delivered later than the delivery time specified in the Purchase Order, the Vendor shall pay to the Purchaser the liquidated damages of the delay as set forth in Article 14 hereof.
卖方同意一旦接到买方的意向书/定货单，以先发生时间为准，卖方将即刻履行合同，快速及勤奋地执行所有各阶段的义务，卖方并且保证将根据定货单条件所指定的装运日期之前交送货物。如果卖方将货物或其中一部分货物的交付时间超过了定货单所规定的交货日期，卖方将根据本合同第14款向买方支付延误违约赔偿金。
